Court grants Trump control over National Guard in LA protests

President Donald Trump is celebrating a legal victory after an appeals court ruled that he can retain control of National Guard troops deployed in Los Angeles following recent protests. Three judges from the 9th Circuit Court of Appeals ruled that the president can seize control of a state’s National Guard as long as there is a “defensible reason” for doing so.The court determined that the Trump administration presented enough evidence of violence from protesters, and that deploying California’s National Guard was in the “federal government’s interest in preventing incidents.” The decision overturns a previous ruling by a lower court, which stated that Trump illegally activated National Guard troops despite clear opposition from California Gov. Gavin Newsom, concerned that it would inflame tensions, waste resources and undermine local authority. The ruling may be temporary as Newsom has pledged to challenge the decision again in court. The decision gives Trump more power to deploy soldiers in certain situations, despite strong objections from a state’s governor or government. It could possibly give more legal precedent for him to use the Insurrection Act, which is something he reportedly considered, allowing troops to act like local law enforcement to manage civil unrest. This ruling also potentially expands the president’s power as he prioritizes deportations in Democratic-run cities.
